Annual Meeting and State of the Lake Address November 15, 2008

 The Smith Lake Environmental Preservation Committee (SLEPC) is hosting the Annual Meeting and State of the Lake Address on Saturday November 15, 2008 at the Dodge House Restaurant at 9 AM. Representatives from the Alabama Water Watch Program (AWW) will be presenting the water quality data collected by the volunteer citizen monitors from around Smith Lake and noting trends and changes around the watershed. Dr. Bill Deutsch, Alabama Water Watch Program Director, Eric Reutebuch, Sergio S.Ruiz-Cordova and others from the AWW program will be in attendance. The meeting is open to the public and everyone is encouraged to attend and bring a friend.

Water Quality Monitoring Training and Re-certification 11-14-08

An Alabama Water Watch chemical water quality monitoring training workshop is scheduled for November 14, 2008 at the Berry’s lake house from 1PM to 6PM along with a re-certification workshop for existing monitors from 3PM to 6PM. Dock Dumping

Dock dumpers can no longer trash and clog community boat launches and back sloughs with their debris. The following is the letter sent by Alabama Power around the end of September 2008:

 

TO:  All Boat Dock Builders/Smith Lake

Recently we are beginning to see problems related to abandoned boat
houses and increases in Styrofoam in sloughs and remote areas of the
lake. Some of this is probably related to the deadline to remove all
white beaded Styrofoam by January 2010.

Some boathouses pulled into sloughs have been found to belong to someone
who has purchased a new dock. On some occasions they were pulled there
to be disassembled later. Our concern is that they will be forgotten and
abandoned.

I have asked my surveillance contractor and the Alabama Marine Police to
be aware of this problem and to investigate any old docks in tow.

Please help us maintain the beauty of
Smith Lake by disposing or
dismantling old docks at the site of the new dock within 10 days of the
change out or towing them back to your assembly points for proper
dismantling or disassembly.

------------------------------------------------------------------------------------------------------------Basically, the new policy says that when new docks are delivered, the old docks cannot be moved from the location of the new dock unless they are going to the final removal location on property the dock builder owns or has rights to or the old dock is dismantled and disposed of at the site of the new dock and removed from the lake within 10 days.

 

Alabama Power Shoreline Management told me that all of the dock assembly locations are south of Ryan Creek Boating Center (Big Bridge) so what this means to all of us is that NO OLD DOCKS WITH BEADED SYTROFOAM SHOULD BE GOING NORTH OR WEST OF RYAN CREEK BOATING CENTER. IF OLD STYROFOAM DOCKS ARE GOING UNDER BIG BRIDGE TOWARD SMITH LAKE PARK THEY ARE GOING THE WRONG WAY. ALSO, ALL OLD DOCKS NORTH OF BIG BRIDGE SHOULD BE MOVING SOUTH IF THEY ARE MOVED AT ALL AND THEY MUST TOW THEM TO THEIR OWN LOCATION FOR DISPOSAL (not to any other slough but their own). In summary, dock builders are no longer allowed to tow old docks to Smith Lake Park, Old 69 Hwy launch, Old 69 Launch at Co.Rd.109 (Mallard Point slough), Calvert's Cove launch or anywhere else except back to the dock builder’s assembly location   If you see old beaded styrofoam docks headed north toward and under Big Bridge you should call Alabama Power Shoreline Management at 205 384-7385 and/or the Cullman County Sheriff's Department at 256 735-2741 and they will contact the Marine Police to report the suspicious activity of a dock dumping in process. If you find a dock dump, you can contact the Cullman County Health Department 256-734-0243 and report an illegal dump--the locations where docks have been dumped are health and safety hazards so if you approach one of these dump sites for a closer look watch for nails and wires, cable, sharp steel, wood splinters, unsafe and/or rotten decking boards and other hazards. 

 

If you can get the numbers off the side of the boat moving the old dock it is helpful to law enforcement, however, we have discovered that some dock movers/builders do not have registration numbers on their boats and we have also found that some have numbers that are not registered to the boat they are operating or have been altered in some way. Detailed photos and descriptions are also helpful.

 

Also, if you are getting a new dock and you have contracted with the dock builder for removal of your old dock, be careful if you pay up front for the removal. You may want to hold out some cash incentive for them to legally dispose of and remove the old dock so you don't wind up with the old dock still at your place with the new dock month after month or find out that your dock was simply dumped on your neighbors a couple of sloughs over from you. If you hold out some cash incentive, then you can have the dock builder send you a written confirmation signed by the well funded owner of the dock building company. If the dock builder has contracted with someone else for dock removal then you should still get the owner of dock building company to send you confirmation because some of the folks contracted to remove old docks have been found to take a long time, make a mess, or be unscrupulous as well as unable to pay for messes they have created or damages they have caused. 

 

If all of us help, we can avoid Smith Lake becoming an ocean of styrofoam icebergs floating and old docks clogging sloughs and making dumps up and down the lake. So please help us keep Smith Lake clean and safe by reporting suspicious activity. Also, Smith Lake Living has a web cam just south of Ryan Creek Boating Center that can be   monitored for all sorts of lake activity at www.smithlakeliving.com.

National Coal proposed Strip Mine in the Brushy Pond Area  

 National Coal is a Tennessee company that has applied for an ADEM storm water permit for a proposed strip mine in the Brushy Pond area. SLEPC submitted comments opposing the permit as did numerous others from all around the lake. This area has been mined, abandoned, re-mined, and finally reclaimed by the Department of Interior’s Office of Surface Mining Abandoned Mine Lands Program. It appears that National Coal applied for this storm water permit before they had a permit to mine or leases for the land they proposed to use. In addition, the company’s web site shows that the company may be in some financial trouble. We are waiting on ADEM; we will keep you posted.  

Dr. Neil Sass, Alabama Dept.  of Health - Fish Consumption Advisories  

 

On September 27, 2008, Dr. Neil Sass, the state epidemiologist for the Alabama Department of Public Health, was our guest speaker discussing the new fish consumption advisories for Smith Lake for mercury. He said that we should all continue to eat fish from Smith Lake except for infants, pregnant women, and women of child bearing age as it effects development in the fetus. The amount of mercury has not increased in the fish; the standard changed for mercury and is now more restrictive. He also said you should vary the fish you eat such as different species, some ocean, some grocery, some lake, etc. and he stressed that the fat should be cut out when cleaning the fish as the mercury accumulates in the fat. He had some hand outs also and the extra copies will be available at the State of the Lake Address meeting on Nov. 15, 2008 at 9am at the Dodge House Restaurant. 

Styrofoam Removal Deadline      

 

Reminder: January 1, 2010 is the deadline for removing non-encapsulated beaded Styrofoam from the lake.

We had our cleanup this spring and removed 17.81 tons or 35,620 pounds of Styrofoam for a total of 1313 tons or 2,626,000 pounds.

Cullman Co. usually has free dump month during May at the landfill for Styrofoam, wood from docks, and other trash. The coupon usually comes with your Cullman Electric Coop power bill prior to the free dump month.    

PLEASE DO NOT ALLOW YOUR DOCK OR STYROFOAM TO LITTER THE LAKE. INSURE PROPER DISPOSAL EVEN IF YOU PAY FOR REMOVAL.

Remember to call Alabama Power’s representatives BEFORE you begin a seawall, a dock or begin construction that could affect land below the water storage easement of 522 feet MSL (mean sea level). Call 205 384-7385 for permitting information and to make an appointment for an onsite visit.

--The Smith Lake slot limit for bass is 13 - 15 inches.  Any bass caught in the slot must be released back into the lake. The total length includes tip of nose to end of tail.

 

--The nine-inch crappie limit has been lifted for public waters of 500 acres or less. Since Smith Lake is 21,200 acres the nine-inch limit on crappie remains in effect for Smith Lake.

                      State Boating Law Highlights                                        

 

---Smith Lake is surrounded by DRY counties and, therefore, not only does the legal blood-alcohol limit of .08 apply but also the laws associated with dry counties. It is our understanding that this means that any alcohol in a boat on Smith Lake, including just one beer, can be considered a violation of the law. As always, the severity of enforcement is up to the discretion of the officer.

 

--Alabama law now requires an annual inspection of onboard waste disposal facilities (heads) to insure that Y valves, if present, have been rendered incapable of discharging to the waterways. If you have a vessel that has a head that has not been inspected, you can contact the Marine Police District Office at 1-800-499-1667 and leave a message for the Smith Lake Marine Police.  

 

---Vessels passing head on should keep to the right. If you cannot see around a bend in the shoreline or a rock formation assume that there is a boat coming at you on the other side and stay well to the right. 

 

---Scuba divers should always have a diver’s flag flying on their boat. The flag should be at least 12 inches square, colored red with a two inch strip running diagonally from the top staff corner to the bottom fly corner. Boaters should stay a minimum or 100 feet away from the displayed flag. 

 

---A properly installed kill switch must be attached to the driver of a moving vessel less than 24 feet long with greater than 50 horsepower.

 

 ---As of April 2003, stern lights (anchor lights) must be at least one meter above the navigational lights (running lights) and must be visible for two miles.

 

----Studies show that 19 of the 22 Alabama drowning deaths in 2004 might have been prevented if the victim had been wearing a life jacket. Something to think about!

 

--The Alabama Marine Police recommend that lake residents place their 911 address somewhere that is visible from the water and that the letters and numbers be reflective and at least three inches high. This could help them identify a location easier and quicker.

----The Alabama Department of Environmental Management (ADEM) oversees any land disturbance of one acre or larger or if the disturbance causes a water quality violation. ADEM’s Decatur office handles this program for the Smith Lake area.  (256) 353-1713.

----Cullman County now has several locations for recycling used motor oil. For a complete list of locations call 1-800-452-5901.

 

----Cullman County Sanitation Department will pick up old appliances such as washers, dryers, refrigerators, etc. This service is free of charge to residential customers. Call (256)287-1142 for pick-up.

Watch for illegally piped discharges to the lake; they are easier to see when the water is low.

 

Please secure items on your docks such as buckets, rafts, and chairs to prevent littering the lake.  

 

Keep an eye out for dock dumpers and report them.
